You must be of legal age to enter into a contract, and if you accept these Terms on behalf of a business, you confirm you have authority to bind that business. You must provide accurate registration information and keep it up to date.

You are responsible for keeping your login credentials confidential and for all activity that takes place under your account and the staff accounts you create. Tell us immediately at support@humsum.in if you suspect unauthorised access.

We grant you a limited, non-exclusive, non-transferable right to use the Service for your own café operations within the plan you have selected. You must not:

• use the Service for any unlawful purpose, fraud or spam;
• infringe the intellectual property or privacy rights of others;
• interfere with the security or integrity of the Service, including uploading malware, probing or scanning our systems, or scraping data;
• reverse engineer, resell or redistribute the Service, or circumvent plan limits.

Humsum retains all ownership of the Service, including its software, design, documentation and branding. You retain ownership of the data and content you enter (menus, orders, customer records, logos) and grant us a limited licence to host and process it solely to provide the Service to you.

We work to keep the Service reliable, but we do not guarantee that it will be uninterrupted, error-free or free of data loss. Maintenance, third-party outages and events beyond our reasonable control may affect availability. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

Plans are sold on a monthly or yearly basis and renew automatically until cancelled. Current prices are shown on our pricing page. Payment, billing, invoicing, taxes, cancellation and refund mechanics are handled by our payment provider in accordance with the Paddle Buyer Terms and our refund policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We may suspend or terminate access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination we will make your data available for export for a reasonable period, after which it may be deleted.

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

You agree to indemnify Humsum against claims arising from the content you upload, your unlawful use of the Service, or your breach of these Terms.

We may update these Terms from time to time. Material changes will be notified in the app or by email, and continued use after the change takes effect means you accept the updated Terms.

These Terms are governed by the laws of India, and the courts of India shall have jurisdiction over any dispute. You may not assign these Terms without our consent; we may assign them as part of a merger or acquisition. Questions? Contact Humsum at support@humsum.in.
